How to Apply for a National Innovation Visa (Subclass 858)?
A National Innovation visa (NIV) (Subclass 858) is targeted towards people who are widely recognised in fields such as a profession, a sport, an art or academia. Applicants will need to still be prominent figures in their fields and will need to be able to establish themselves in Australia in that field and be an asset to the community. Presumably, this requirement shouldn’t be difficult at all to meet and simply ensures that successful applicants will continue to provide valuable contributions to their field whilst they are Australian permanent residents (PR).
Do I need to put in an Expression of Interest (EOI) for the National Innovation (Subclass 858) Visa?
Applicants will need to first submit an Expression of Interest (EOI) before they can be invited to apply for a National Innovation (Subclass 858) visa. If an invitation is received, then applicants will need to accept it within 6 months. This stage of the process is similar to the early stages of a General Skilled Migration (GSM) application, although there are no points tests involved for the NIV.
Is there an age limit for Applying for NIV (SC858)?
Although there is no strict age requirement for this visa, applicants who are between the ages of 18 and 54 should have the easiest time applying. Anybody who is outside this age range will need to demonstrate that they would be of exceptional benefit to the Australian community, likely because it is more uncertain whether they will continue being prominent members of their field if they are quite young or old.
Can I apply for NIV (Subclass 858) Onshore?
If applicants want to apply for this visa whilst onshore, then they will need to either hold a substantive visa or a Bridging Visa A (BVA) (Subclass 010), Bridging Visa B (BVB) (Subclass 020) or Bridging Visa C (BVC) (Subclass 030). There are no restrictions for offshore applicants.
Do I need a nominator to verify my NIV (SC 858) application for me?
As the purpose of this visa is to allow prominent and internationally recognised individuals to reside permanently in Australia, a Form 1000 will need to be completed. An Australian person or organisation will need to attest to the applicant’s achievements by nominating them through Form 1000. A nominator will need to have a national reputation in the same field as the applicant, likely so that they can properly assess the applicant’s achievements. As part of completing a Form 1000, the nominator will essentially need to describe how the applicant meets all the key criteria for the visa – such as why they are prominent in their field, why they would be an asset to the community and why they wouldn’t have any issues establishing themselves in Australia.
Other visa requirements
The remaining visa requirements are clear-cut. Applicants must satisfy the Public Interest Criteria 4001 (Character test), 4002, 4003, 4003B, 4004, 4007 (Health test with waiver), 4009, 4010, 4019, and 4021. Apart from the usual first-entry criteria, which stipulate arrival by a specified date, there are no additional conditions.
