Understanding Public Interest Criterion 4022 – Code of Behaviour for BVE Holders

Some Bridging Visa E (BVE) (Subclass 050) must meet the Public Interest Criterion (PIC) 4022 – Code of Behaviour for the visa to be granted. A new instrument was issued, and it commenced on 28 February 2025, as the earlier instrument was scheduled to self-repeal.

This new instrument replaces the previous Code of Behaviour instrument to ensure continuity beyond 31 March 2025. Importantly, the new instrument does not introduce significant changes; its purpose is to continue the previously approved guidelines. 

What is the purpose of the PIC 4022 - Code of Behaviour for Bridging Visa E (BVE) holders? 

The PIC 4022 - Code of Behaviour specifically applies to Bridging Visa E (BVE) (Subclass 050) visa applicants. The following criteria clarify the individuals to whom this regulation pertains: 

  • Applicants must be at least 18 years old at the time of their application. 

  • They must currently hold or have previously held a BVE visa that was granted under section 195A of the Migration Act 1958, which is exercised at the Minister’s discretion. 

This Code outlines the expected standards of behaviour for individuals who are released from immigration detention on a BVE and ensures that they conduct themselves appropriately within the community.
