Can I Extend My BVB When I’m Offshore?
If you are holding a Bridging Visa A (BVA) (Subclass 010) while waiting for your pending visa application to come to a decision, you will have to travel offshore from Australia. As BVA holders do not have travel facilities to travel offshore, they are eligible to apply for Bridging Visa B (BVB) (Subclass 020) to travel offshore for a specified period.
What is Bridging Visa B (BVB) (Subclass 020)?
A Bridging Visa B (BVB) (Subclass 020) allows individuals in Australia who need to travel overseas temporarily for a specific purpose (i.e. family matters, work commitments or emergencies) while still maintaining their legal status in the country.
How Long Is A BVB Valid?
The BVB is usually granted for a limited time to cover the duration of the intended overseas trip. BVB holders must be aware of travel restrictions and ensure compliance with the specific conditions attached to their visas.
If I Have To Extend My Overseas Trip, Can I Extend It While I’m Offshore?
Unfortunately, you cannot apply for Bridging Visa B (SC 020) offshore. You will have to return to Australia before the travel facility ends.
If you are required to travel again, you will have to reapply for another BVB and wait for it to be granted before leaving Australia. Otherwise, you may not have a visa to enter Australia. Additionally, you may be subject to Public Interest Criteria (PIC) 4014 if you have a prior visa cancellation, which could possibly result in a re-entry ban. Alternatively, explore different types of visas to apply for that may be suited to your circumstances in order to re-enter Australia. Book a time with an Immigration lawyer to discuss what your options can be.
