Grandfathered Subclass 457/TSS Visa - TRT Application Last Day of Visa Validity

About Subclass 186 Visa TRT Visa Application

Subclass 186 visa has two streams, the Temporary Residence Transition (TRT) Stream and the Direct Entry (DE) Stream. To apply in the TRT Stream, you must have held Subclass 457 visa or a TSS visa for at least 2 of the last 3 years prior to application, or related bridging visa granted in association with one of these subclasses.

Grandfathered Subclass 457 Visa or Subclass 482 Visa

If you held or had applied for a Subclass 457 visa on or before 18 April 2017 which was subsequently granted and continues to hold this visa or a TSS visa or related bridging at the time of TRT application, grandfathering provisions will apply under the TRT Stream.

There has been recent amendment to the Procedural Instructions at Regulation 5.19. which provides that where the nomination is lodged on or after 18 March 2018, and at any time until 18 March 2022, standard nomination requirements must be met, except:

  • the occupation list requirements will not apply, so you can still apply for TRT Stream even if your occupation had been removed from the skilled occupations list

  • the TRT applications can be lodged after holding Subclass 457 or TSS visa for 23 months as opposed to two-year requirement to be eligible to apply for TRT Stream. This effectively removes the necessity to obtain a further TSS visa to complete the two-year requirement.

Key Takeaways for Subclass 186 Visa TRT Stream

People eligible to apply for TRT Stream under Subclass 186 visa are now provided a concession for time spent on a Subclass 457 visa or TSS visa to 23 months instead of 24 months before applying for TRT Stream. This not only provides an additional month for sponsoring companies and applicants to seek permanent residence and also reduces significant costs in making a new TSS visa application only to satisfy the two-year requirement.
